1. Purpose of the Application
EZ Booking is an application intended for professional and independent VTC drivers.
In particular, it allows the User to:
- create and manage bookings;
- register customers;
- provide company information;
- provide vehicle information;
- generate purchase orders linked to bookings;
- consult their activity.
The Application is designed as a tool to help manage the professional activity of VTC drivers.
At this stage, the Application does not yet offer payment features via the application, invoice generation, booking sharing between drivers, or group creation.
2. Definitions
In these TOS, the following terms have the meaning indicated below:
- Application :Application: refers to the EZ Booking mobile application.
- Éditeur :Editor: refers to the company operating the Application.
- Utilisateur :User: refers to any professional driver using the Application.
- Client :Customer: refers to the User's final customer, for whom a booking can be created.
- Réservation :Booking: refers to a trip or transport service created by the User in the Application.
- Bon de commande :Purchase Order: refers to the document generated by the Application based on the information provided by the User.
- Compte :Account: refers to the personal space created by the User in the Application.
3. Access to the Application
Access to the Application requires the creation of a user account.
The User agrees to provide accurate, complete, and up-to-date information when creating their account and when using the Application.
The User is responsible for the confidentiality of their login credentials. Any use of their account is presumed to have been carried out by them, unless proven otherwise.
In case of fraudulent or unauthorized use of their account, the User agrees to inform the Editor as soon as possible.
4. Terms of Use
The Application is reserved for professional VTC drivers or persons carrying out a professional activity related to the transport of persons with a driver.
The User declares:
- to have the necessary authorizations to carry out their activity;
- to be solely responsible for the compliance of their professional activity;
- to use the Application in compliance with applicable laws and regulations;
- not to use the Application for fraudulent, illegal purposes or contrary to its destination.
The Application is not a substitute for the User's professional, administrative, fiscal, accounting, or regulatory obligations.
5. Role of the Editor
The Editor provides the User with a digital tool to facilitate the management of certain information related to their activity.
The Editor is not a transport company, does not perform any transport service, and does not intervene in the commercial relationship between the User and their own customers.
The User retains full responsibility for:
- their customers;
- their bookings;
- their rates;
- their professional obligations;
- the information provided in the Application;
- the documents generated from this information.
6. Information Provided by the User
The User may be required to provide various information in the Application, including:
- personal information;
- company information;
- SIRET number;
- eVTC number;
- vehicle information;
- information related to their customers;
- information related to bookings.
The User guarantees the accuracy, sincerity, and updating of the information entered.
The Editor cannot be held responsible for the consequences linked to inaccurate, incomplete, obsolete, or erroneous information provided by the User.
7. Customers Registered in the Application
The User can register information related to their customers to facilitate the creation of bookings and the generation of purchase orders.
The User agrees to provide only the data necessary for their professional activity.
The User guarantees to have an appropriate legal basis for registering and using their customers' data as part of their activity.
The User is responsible for the use of the customer information they provide in the Application.
8. Bookings
The User can create bookings by providing in particular:
- a customer;
- a pickup address;
- a destination address;
- a date and time;
- a vehicle;
- any other information useful for the completion of the trip.
The User remains solely responsible for the actual performance of the transport service.
The Editor does not guarantee the execution of a booking and does not intervene in the relationship between the User and their customer.
9. Purchase Orders
The Application allows the User to generate purchase orders based on the information provided.
The purchase order is automatically generated by the Application based on the data entered by the User.
The User is solely responsible for:
- the accuracy of the information appearing on the purchase order;
- the compliance of their activity;
- the use of the purchase order as part of their service.
The User must check each purchase order before any use or transmission.
The Editor cannot be held responsible for any error, omission, or incorrect information appearing in a purchase order when this error results from the information provided by the User.
11. Application Availability
The Editor strives to make the Application accessible in the best possible conditions.
However, the Editor does not guarantee permanent, continuous, or error-free access to the Application.
Access to the Application may be suspended temporarily, in particular for:
- maintenance;
- updates;
- correction of anomalies;
- technical evolution;
- force majeure;
- problems beyond the Editor's control.
The Editor cannot be held responsible for the consequences linked to a temporary unavailability of the Application.
12. Application Evolution
The Editor reserves the right to evolve the Application at any time.
Features may be added, modified, suspended, or deleted in order to improve the service, take user feedback into account, or comply with new legal, technical, or operational obligations.
The User will be informed when these developments have a significant impact on the use of the Application.
13. Forbidden Behaviors
The User is specifically prohibited from:
- using the Application for fraudulent or illegal purposes;
- providing false information;
- impersonating a third party;
- undermining the proper functioning of the Application;
- attempting to access accounts, data, or systems without authorization;
- copying, modifying, or misappropriating the Application or its content;
- using the Application in a way likely to harm the Editor, other users, or third parties.
In case of failure, the Editor may suspend or delete the User's account, without prejudice to any eventual legal action.
14. Account Suspension or Deletion
The Editor may suspend or delete a User's account in case of:
- violation of these TOS;
- fraudulent use of the Application;
- false information;
- behavior harming the service;
- request from competent authorities;
- legal or regulatory obligation.
The User can also request the deletion of their account from the Application or by contacting the Editor at the following address: contact@ez-booking.fr.
Account deletion results in the deletion or anonymization of associated data, subject to the data that the Editor must retain to comply with its legal obligations or defend its rights.
15. Personal Data
The use of the Application involves the processing of personal data.
These treatments are described in the Application's Privacy Policy, accessible at the following address: https://www.ez-booking.eu/privacy-policy .
The Editor undertakes to process personal data in compliance with applicable regulations, in particular the General Data Protection Regulation (GDPR).
The User has in particular rights of access, rectification, erasure, limitation, opposition, and portability, under the conditions provided for by the applicable regulations.
To exercise their rights, the User can contact the Editor at the address: contact@ez-booking.fr.
16. Confidentiality and Security
The Editor implements reasonable measures to protect the data and information stored in the Application.
The User acknowledges, however, that no computer system can guarantee absolute security.
The User is responsible for the protection of their phone, their password, and access to their account.
In case of loss, theft, or unauthorized use of their account, the User must notify the Editor as soon as possible.
17. Intellectual Property
The Application, its name, its interface, its texts, its graphic elements, its design, its features, its structure, and all the elements that compose it are protected by intellectual property rights.
Without prior written authorization from the Editor, the User is prohibited from:
- copying;
- reproducing;
- modifying;
- adapting;
- distributing;
- commercially exploiting;
- decompiling;
- attempting to extract the source code of the Application.
The use of the Application does not result in any transfer of intellectual property to the User.
18. Editor Liability
The Editor provides a tool to help manage the User's activity.
The Editor cannot be held responsible for:
- information entered by the User;
- documents generated from incorrect information;
- the relationship between the User and their customers;
- the execution or non-execution of a trip;
- the professional, administrative, fiscal, social, or regulatory obligations of the User;
- misuse of the Application;
- temporary unavailability of the Application;
- indirect damage, such as loss of turnover, loss of customers, loss of business, or damage to image.
The User acknowledges using the Application under their sole responsibility.
19. User Liability
The User is solely responsible for their professional activity and the use they make of the Application.
In particular, it is up to them to:
- verify the accuracy of the information provided;
- verify the documents generated;
- respect the rules applicable to their activity as a VTC driver;
- respect the rights of their customers;
- use the Application in accordance with these TOS.
The User guarantees the Editor against any claim, action, or demand coming from a third party and linked to a non-compliant use of the Application or to erroneous information provided by the User.
20. Customer Service and Assistance
For any questions related to the use of the Application, the User can contact the Editor at the following address: contact@ez-booking.fr.
The Editor will strive to respond as soon as possible, without guaranteeing a specific response time.
21. TOS Modification
The Editor reserves the right to modify these TOS at any time, in particular in case of:
- evolution of the Application;
- addition of new features;
- legal, regulatory, or technical modification;
- change in the operating conditions of the service.
In case of a major modification, the User may be informed by any appropriate means, in particular via the Application or by email.
Continued use of the Application after modification of the TOS constitutes acceptance of the new conditions.
22. Force Majeure
The Editor's liability cannot be engaged in case of non-performance or delay in the performance of its obligations resulting from a case of force majeure within the meaning of French law.
In particular, the following are considered cases of force majeure: widespread network failure, cyberattack, interruption of a third-party service, natural disaster, fire, strike, administrative decision, or any event beyond the Editor's reasonable control.
23. Applicable Law
These TOS are subject to French law.
In case of difficulty related to the interpretation, execution, or validity of these TOS, the parties will strive to seek an amicable solution.
Failing an amicable resolution, the dispute will be submitted to the competent jurisdictions in accordance with the rules of common law.
24. TOS Acceptance
When creating their account or first using the Application, the User acknowledges having read these TOS and accepting them without reservation.
